L’area tematica analizza, in prospettiva sistematica e attuale, i principi fondamentali, le fattispecie di reato, il sistema delle pene e le procedure penali, esaminandone l’evoluzione normativa e interpretativa alla luce delle trasformazioni sociali e istituzionali contemporanee.
L’attenzione è rivolta alle funzioni del diritto penale nell’ordinamento giuridico, ai rapporti tra repressione, prevenzione e garanzie, nonché alle ricadute del fenomeno punitivo sui diritti fondamentali, sull’equilibrio tra sicurezza e libertà e sulla coesione sociale.
The thematic area examines, from a contemporary and systematic perspective, the fundamental principles, criminal offences, penal sanctions, and criminal procedures, analysing their normative and interpretative development in light of ongoing social and institutional transformations.
Particular attention is devoted to the role of criminal law within the legal system, the relationship between punishment, prevention, and procedural safeguards, as well as the impact of penal policies on fundamental rights, the balance between security and freedom, and social cohesion.
