L’area tematica indaga, con approccio storico-critico e interdisciplinare, l’evoluzione degli ordinamenti giuridici nel tempo, con particolare attenzione al Diritto Romano e alla sua persistente influenza sulla formazione degli istituti giuridici moderni. L’analisi si concentra sulle radici storiche del diritto, sulle continuità e discontinuità normative e sulle modalità attraverso cui le esperienze giuridiche delle antichità hanno contribuito a plasmare i sistemi giuridici contemporanei e le attuali fonti normative.

Un rilievo centrale è attribuito alla storiografia giuridica quale strumento metodologico essenziale per comprendere il significato, la funzione e l’evoluzione delle categorie giuridiche, nonché per trarre indicazioni critiche utili all’interpretazione del diritto positivo.

The thematic area examines, through a historical-critical and interdisciplinary approach, the evolution of legal systems over time, with particular emphasis on Roman Law and its enduring influence on the development of modern legal institutions. The analysis focuses on the historical foundations of law, the continuities and discontinuities of legal norms, and the ways in which ancient legal experiences have shaped contemporary legal systems and current sources of law.

Special attention is given to legal historiography as an essential methodological tool for understanding the meaning, function, and evolution of legal categories, as well as for deriving critical insights relevant to the interpretation of positive law.
